    To have rights to a trademark in Ukraine, you must register it. Ukraine operates on a 'first to file' basis.

    Yes, you must provide a power of attorney.

    Can someone claim priority for a patent application in Ukraine, and if so, what are the requirements?

    To claim priority in Ukraine, the following conditions must be met:

    • The applicant's country must be a member of the Paris Convention.
    • The original application must have been filed within the last six months before applying in Ukraine.
    • The applicant needs to submit a priority declaration, including the filing date and application number of the earlier application.
    • A Ukrainian translation of the application must be submitted to the Patent Office within three months from the application date.

    What actions are necessary to meet the usage requirement for a trademark?

    You need to use the trademark within three years from when it was registered. Even a small amount of use is enough, but it must happen in Ukraine.

    Can a registration be canceled?

    Registration can be canceled for the following reasons:

    What is the duration of the opposition period for a trademark application?

    The opposition period starts when interested parties find out about a conflicting trademark application.

     

    A trademark application can be opposed at the Patent Office. It cannot be done in court. The deadline is up to five days before the trademark registration decision is finalized.

    How long is a trademark valid once it has been registered?

    The trademark registration is valid for 10 years starting from the date you apply.

    Do I need to use my trademark before applying for registration?

    You don't need to use your trademark or plan to use it before applying for registration.
