Published details include the mark, goods/services, application number and date, applicant's name and address, priority claim, and class number.
  • Registration – After completing the prosecution process, overcoming any oppositions, and ensuring no other refusal grounds exist, the authorities will issue the registration.
  • What actions are necessary to fulfill the usage requirement?

    To meet the use requirement, the mark must be used consistently for five years. While the law doesn't specify how much it needs to be used, it must be used within Poland.

    Can a registration be canceled?

    Yes, you can cancel a registered mark for the following reasons:

    • It conflicts with an earlier registration or proprietary rights.
    • The mark is descriptive, misleading, disparaging, deceptive, functional, or generic.
    • It conflicts with a registered design or a personal name.
    • The mark goes against public policy and moral principles.
    • It conflicts with trade names.
    • It conflicts with well-known marks.
    • It conflicts with protected emblems, flags, and armorial bearings.
    • The mark is registered in an agent’s name.
    • It has a geographical indication.
    • There is a copyright infringement.
