The "Mexican Institute of Industrial Property" (IMPI) requires indicating in trademark applications whether the trademark is new or has already been used in commerce. If you have already used the trademark in Mexico, the exact date and address of the establishment where it began to be used must be provided. The reported first-use date cannot be modified later. It is essential to have evidence supporting this date and showing the trademark, as in the event of a conflict, the evidence is crucial to demonstrate that the trademark holder has ownership and exploitation rights. Priority Claim allows you to use the filing date of a previously filed trademark application in another country as the filing date for this application. To be eligible, the previously filed trademark application must be for the same trademark and have been filed within the last 6 months. Please note that the trademark applications must be identical in order to claim priority.

This POA should be signed by the owner or legal representative of the trademark. We will send you the POA template with instructions as soon as you place your order.
