You will need to provide the date of first use and a specimen of use, at no additional cost. ▶ Intent to Use Select this option if your trademark is not yet in use in the United States and has not been registered or applied for in another country. Once the trademark is approved — typically about 7 months after the application — you will need to submit a Statement of Use with proof that the mark is now in use. If you are not ready to provide proof of use at that time, you may request up to five 6-month extensions. ▶ Foreign Registration • If your trademark is already registered in another country where you have a bona fide business address, you may file under the Foreign Registration basis by submitting a scanned copy of the foreign registration certificate. • If your trademark was filed abroad within the last 6 months but is not yet registered, you may apply under the Foreign Application basis. Once approved, you must then submit either the Foreign Certificate or a Statement of Use.
Priority Claim allows you to use the filing date of a previously filed trademark application in another country as the filing date for this application. To be eligible, the previously filed trademark application must be for the same trademark and have been filed within the last 6 months. If you select Priority Claim, we will request the details of the foreign application after you fill this form. Please note that the trademark applications must be identical in order to claim priority.
